Terms of use

1. Scope
1.1 The use of the internet pages (hereinafter referred to as "BUAG-WEB SITE") provided by BÖHLER-UDDEHOLM AG (hereinafter referred to as "BUAG") is exclusively subject to these TERMS OF USE.

1.2 By logging in or visiting the BUAG-WEB SITE the TERMS OF USE, as amended from time to time, are accepted by the user and binding for the user with log in or visit of the website. 

1.3 These TERMS OF USE can, in individual cases, be amended, modified or replaced by other terms and conditions, in particular on an individual contractual basis. In the event of any conflict, said individual terms and conditions shall prevail over these TERMS OF USE. They are not applicable if and to the extent they are in conflict with mandatory law. 

1.4 For the purpose of easier legibility, references to persons are generally not gender-specific. In the event that persons are referred to in the masculine form this automatically includes also female users.


2. Exclusion of liability, warranty and liability

2.1 Information and data (hereinafter referred to as "INFORMATION") made available to you on this BUAG-WEB SITE have been compiled with due diligence. BUAG has taken all reasonable efforts to ensure that the INFORMATION is correct and complete at the time of publication and will regularly update and extend them, however, BUAG can not guarantee the correctness and completeness of the content. BUAG apologises for any unintentional and accidental errors that occur nevertheless and asks you to excuse these.

2.2 BUAG reserves the right to change or amend the INFORMATION at any time without prior notice.
 
2.3 BUAG excludes any liability, warranty or guarantee with regard to the accuracy and completeness of the INFORMATION or for any adverse consequences that may result or result from the use of the INFORMATION. Any decisions of the user that are based on the INFORMATION exclusively lie within the user's responsibility. BUAG excludes any liability for direct or indirect damages, consequential damages and other damages of any kind that may occur or occur in connection with the direct or indirect use of the INFORMATION. 

2.4 INFORMATION made available on the BUAG-WEB SITE does not represent a call to buy or deal with shares of voestalpine AG (parent company). 

2.5 To the extent the BUAG-WEB SITE contains statements referring to the future, these statements are based on opinions and evaluations of the BUAG-Management and, consequently, are subject to risks and uncertainties. BUAG is not obligated to update such statements that refer to the future. Any liability for such statements is expressly excluded. 

2.6 BUAG, at its sole discretion, is authorised to completely or partially shut down the operation and use of the BUAG-WEB SITE. BUAG excludes any liability, warranty or guarantee for the uninterrupted availability of the BUAG-WEB SITE and that the INFORMATION provided is error free or that errors are corrected. In particular, BUAG excludes any liability, warranty or guarantee that may result or results from limitations of use or non-availability of the BUAG-WEB SITE. 

2.7 Although BUAG uses all reasonable endeavours to keep the BUAG-WEB SITE free from viruses, BUAG can not guarantee a virus-free environment. Prior to visiting or using the BUAG-WEB SITE, including, without being limited to, downloading INFORMATION, the user will ensure the set up and application of appropriate safety precautions and virus scanners for their own protection and for the avoidance of virus transmission on the BUAG-WEB SITE. 

2.8 The BUAG-WEB SITE may contain hyperlinks to web sites of third parties. BUAG excludes any liability for the content or accuracy of such sites, since BUAG does not have any influence on such linked content. 


3. Rights of use to INFORMATION 

3.1 The use of the INFORMATION made available on the BUAG-WEB SITE is subject to these TERMS OF USE. Separate provisions, in particular utilisation or licence conditions included in individual contracts of BUAG, shall prevail over these TERMS OF USE. 

3.2 BUAG grants the user a non-exclusive, unilaterally revocable and not transferable right to use the INFORMATION to the extent stated on the BUAG-WEB SITE or, in the event that nothing is stated, for the purpose intended by BUAG in making them available. 

3.3 Publication, distribution, reproduction or transmission as well as downloading, printing, saving or any other use of INFORMATION is permitted exclusively for personal and informative use. Any other use of INFORMATION that may directly or indirectly be retrieved from the BUAG-WEB SITE is permitted only with the prior written consent of BUAG. 

3.4 Changing the content and the composition of the BUAG-WEB SITE, including the framing or similar measures, is not permitted. 

3.5 INFORMATION and design of the BUAG-WEB SITE are protected by various copyright laws and international copyrights treaties and other laws and conventions related to intellectual property irrespective of any designation (e.g. ©, ®, or TM signs). 

3.6 Except for the rights explicitly granted in these TERMS OF USE, the user is not granted additional rights of any kind, especially with regard to the company names or industrial property rights, including, without being limited to, patents, utility patents or grants, nor is BUAG under a corresponding obligation to grant such rights. Unless stated otherwise, all trademarks, company logos, signs or other designations used on the BUAG-WEB SITE are protected under trademark law. 


4. Protection of data privacy 

4.1 BUAG welcomes the interest of the users in BUAG and its products. In order to be able to comprehensively fulfil information requests, users may be asked to submit personal information as for example name, address, email address, interest etc. 

4.2 Personal data are subject to the Data Protection Act of 2000 (Datenschutzgesetz 2000) in Austria and will be processed by BUAG in accordance with the respective provisions. 

4.3 Every user of the BUAG-WEB SITE providing other information and data to BUAG than personal data, grants BUAG unlimited rights to such information and permits BUAG to use such information in any way it wishes. 


5. Place of jurisdiction, applicable law 

5.1 The exclusive place of jurisdiction shall be Vienna, Austria. This does not apply if the user is a consumer and has residence, usual place of living or place of employment in another circuit court in Austria. 

5.2 Austrian law shall apply. The application of the United Nations Convention on Contracts for the International Sale of Goods of 11 April 1980 shall be excluded. In the event, that the user is a consumer with the usual place of living in a state other than Austria, then, based on binding legal regulations, the consumer protection provisions of this country may have priority over this choice of law.

Objects of Business

1. The Company’s objects of business is to act as a holding company for the companies combined as a group under its uniform management. Objects of business of these group companies is in particular the industrial production, finishing and processing and distribution of as well as the trade in steel, in particular in special steel, welding consumables, special forgings and precission strip products as well as industrial services.

2. The Company may establish branches in Austria and abroad, it may acquire participations in companies of any kind in Austria and abroad, acquire, set up and sell such companies as well as engage in any business that is convenient to directly or indirectly furthering the Company’s and the group’s interests.
